Rights Explained:

This amendment also protects the citizens from the courts and the government.  This amendment was copied almost exactly from the English 1689 Bill of Rights.  The court must set your bail at an amount which you will pay in order to guarantee that you will show up for your trial.  They can’t make it more then that. No excessive fines, means that the punishment must fit the crime.  It can not be too harsh when it comes to money.  Cruel and unusual is the big part of this amendment, and one which has changed the most over the years.  Nowadays putting people in stocks or hanging them is considered cruel and unusual.  People want any execution to be made “cruel and unusual” or illegal.  The Roper vs. Simmons case currently in the US Supreme Court wants to make juvenal executions illegal.  This last part of this amendment, sure causes a huge controversy.
